Coming Soon: Annual E-Verify Records Disposal
On February 17, USCIS sent notices to E-Verify enrolled employers to announce the annual disposal of E-Verify records that are greater than 10 years old. The government uses the record disposal to help reduce security and privacy risks associated with retaining personally identifiable information. The record disposal was originally set to go into effect on May 14, 2021. On May 19, 2021 E-Verify extended the deadline to June 4, 2021. The record disposal applies to records dated on or before Dec. 31, 2010. E-Verify will provide employers with an opportunity to download the case information from the Historic Records Report before June 4. The historic records report includes:
- Company name and location
- Initiated date and verification case number
- Employee name and date of initial resolution
- Date of additional resolution and final status
- Case closure date and case closure description
E-Verify requires employers to record, or print and file the E-Verify case verification number for each corresponding Form I-9. Employers may also retain the Historic Records Report with the corresponding Forms I-9. USCIS has provided instructions for downloading the report.
Good News for Equifax I-9 Management Clients
Equifax clients using the I-9 Management service to process I-9s and E-Verify transactions will not be impacted by the record disposal timeline, and no further action is required. Equifax stores the E-Verify data within the I-9 Management platform, outside of the E-Verify system. The I-9 Management application will continue to maintain your E-Verify and Form I-9 records in accordance with I-9 retention requirements.
