TPS Extension for Beneficiaries for Six Countries

On December 7, 2020 the Department of Homeland Security (DHS) announced a new Federal Register Notice that provides continuation of documentation for Temporary Protected Status (TPS) extension for beneficiaries for six countries:

"This notice further provides information on the automatic extension of the validity of TPS-related Employment Authorization Documents (EADs); Notices of Action (Forms I-797); and Arrival/Departure Records (Forms I-94), (collectively “TPS-related documentation”); for those beneficiaries under the TPS designations for El Salvador, Haiti, Nicaragua, Sudan, Honduras, and Nepal.

DHS is automatically extending the validity of TPS-related documentation for beneficiaries under the TPS designations for El Salvador, Haiti, Nicaragua, Sudan, Honduras, and Nepal for nine months through October 4, 2021, from the current expiration date of January 4, 2021."

What does a TPS Extension mean for Form I-9?

Form I-9 responsibilities extend past the time of hire. One of these responsibilities for employers is making sure an employee’s work authorization stays current. Some Employment Authorization Documents expire and then need to be reverified.

Here are some of the challenges employers face with Form I-9 reverification:

• Understanding which documents need to be reverified and when
• Keeping current on which employees’ documents are about to expire
• Sending reminders to employees that they will need to provide updated documents for their work authorization

Based on global events, the DHS may designate certain countries for TPS if conditions there prevent nationals from returning home safely. If this occurs, DHS may extend the validity of any expiring employment authorization documents.
