In our recent blog post: New E-Verify TNC Action Requirement, we reviewed an E-Verify policy that was introduced on October 5, which requires employers to take action on Tentative Nonconfirmations (TNCs) within 10 federal business days. E-Verify also announced the rolling-out of a communications campaign to help keep employers informed and better understand their obligations. On October 26, E-Verify distributed an initial email announcement to enrolled employers.
The email communication reiterates some E-Verify basics and how E-Verify works.
What is an E-Verify TNC?
E-Verify is a web-based tool that compares information from an employee’s Form I-9 to Social Security Administration (SSA) and Department of Homeland Security (DHS) records. Employers create a case, then typically receive a response rather quickly. If the SSA and DHS records match the information on the Form I-9, the employee's E-Verify case, generally produces an Employment Authorized result. The Employment Authorized result confirms the employees work eligibility. If the informaton does not match, a Tentative Nonconfirmation result is produced. A TNC indicates that the employee needs to take further action to complete the case to verify employment eligibility.
In the event of a TNC result, the employer must notify the employee and provide the employee a chance to take action to resolve the mismatched result.
E-Verify’s recent communication also serves as a reminder to employers to take action on TNCs within 10 federal working days.
